Centre Associate Russell Goldflam will present "The (non) role of customary law in sentencing" on Day 2 of the National Indigenous Legal Conference 2013.
Presentation abstract:
A survey of Northern Territory judicial and statutory approaches over 100 years to sentencing involving customary law issues yields some surprising results. Recent enactments prohibiting courts from having regard to customary law in assessing the seriousness of an offence mark a turning point in recognition of customary law.
